1、Basis of application
According to Article 37 of the "Food Safety Law of the People's Republic of China": "Using noval food to produce food, or to produce new varieties of food additives or new varieties o ffood-related products, shall submit the safety assessment of related products to the health administration department . The administrative department of health under the State Council shall organize an examination within 60 days from the date of receipt of the application; if it meets the food safety requirements, permit and publish it; if it does not meet the food safety requirements, it shall not grant a permit and explain the reasons in writing.” Article 93: "Import of foods produced with noval food or imported new varieties of food additives, new varieties of food-related products shall be handled in accordance with Article 37 of this Law."

On September 27, 2019, the General Administration of Customs and the National Health Commission jointly issued Announcement No. 152 of 2019 ("New Food Raw Material License Certificate" and other 2 types of regulatory documents related to exit port verification"), the announcement stipulates: From the date of the announcement, two types of regulatory documents (hereinafter referred to as documents), including the "License Certificate of New Food Ingredients" and the "Standards for the Provisional Application of Imported Foods Without National Food Safety Standards" (hereinafter referred to as documents), will be withdrawn from the port inspection and imported new food ingredients When there is no national food safety standard for food, it shall comply with the corresponding announcements or requirements of the National Health Commission in accordance with the law. There is no need to fill in the relevant information such as the name and number of the above-mentioned certificate in the import declaration process.

Article 19 of the "Administrative Measures for the Safety Review of New Food Ingredients" stipulates: "If the food contains new food ingredients, the product labeling and identification shall comply with national laws, regulations, food safety standards and the requirements of the announcement of the National Health and Family Planning Commission."
Therefore, when the pre-packaged food contains new food ingredients that have been announced, and the announcement clearly requires that the consumption and the unsuitable people be indicated in the label and instructions, it should be labeled, for example, "About Approval of Ginseng (Artificial Planting) as a New Resource The Food Announcement clearly stipulates that pregnant women, breastfeeding women, and children under the age of 14 are not suitable for consumption, and labels and instructions should indicate inappropriate people and consumption limits. If there are requirements for consumption and unsuitable people in the announcement, but not required to indicate in the label or manual, the food manufacturer can choose whether to indicate it or not.

"New Food Raw Material Examination and Approval Service Guide" stipulates that the application materials for new food raw materials shall include the following contents, and shall be arranged in the following order, with page number marked one by one, and there shall be distinguishing marks between them:

A sample of the smallest unopened package or 30 grams of raw materials is also attached.
To apply for the import of new food raw materials, in addition to the above-mentioned materials, the following materials should also be submitted:：
（1）Certificate materials issued by the relevant departments or institutions of the importing new food raw materials exporting country (region) allowing the product to be produced or sold in the country (region)；
（2）Certificate materials issued by relevant agencies or organizations of the country (region) where the imported new food raw material production enterprise is located to review or certify the production enterprise.
